Terms and Conditions
Fees
A non-refundable deposit is due at the time of booking in order to secure your session date and time. Your session is not confirmed until this deposit has beåen received in full. In the event of cancellation, this deposit shall not be refunded and will be used to cover expenses to the photographer for the cancellation. The remaining balance is due no less than 48 hours prior to the session. If the balance is not paid on time, the photographer reserves the right to cancel the session and the client shall lose their deposit. The fee covers the time and talent of the photographer plus retouching and editing of the agreed number of images. Studio hire will be charged to the client if applicable.
Late Arrivals
If a client is more than 15 minutes late, the session will be cancelled and the deposit forfeited.
Cancellations & Rescheduling
If an illness or other situation prevents a photo session from taking place, the client may reschedule their session up to 2 days before the shoot without penalty. Should the client fail to give 2 days notice or decide to completely cancel the shoot, the initial deposit shall be forfeited and will not be refunded. The photographer reserves the right to reschedule the shoot due to illness, weather, equipment malfunction or other problems beyond their control.
Re-shoots
Re-shoots will be determined by the photographer. Clients are not entitled to re-shoots due to poor choices of clothing, make-up, hair or weather related issues.
Failure to Perform
If the photographer cannot perform this contract due to any cause beyond the control of both parties, the photographer and client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, the photographer shall return the full amount paid to the client and shall have no further liability. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the total value of the client’s order.
Proofs
A proofing gallery of low resolution previews will be available within 48 hours of the session date.
Archive
The proofing gallery will be available for a minimum of three months after the shoot. Final images will be delivered via a download link which is valid for 7 days only. After 6 months, all images from the session may be purged from the photographer’s hard drive and will no longer be available. Should the client need any images to be sent for a second time, there will be a £15 administration fee. This fee must be paid in advance of the re-delivery of images.
Use of Images
Unedited proofing images may not be shared or used under any circumstances. The client’s use of the final edited images is limited to use on casting web sites (Spotlight, agent’s web site etc), the client’s personal web site and alongside biographies in production programmes. Images may not be used for any commercial or promotional venture (e.g. in editorial features in newspapers/magazines/online, marketing material such as posters for productions etc.) without a licence from Mark Macdonald Photography. This can be arranged by contacting hello@markmacdonaldphoto.com. Mark Macdonald Photography retains all copyright to all images created during a client’s session and has permission to use the images (or variations of the images) from this session for publication, in advertising materials, websites, blogs, portfolios or other promotional methods for Mark Macdonald Photography. The copyright of the images remains with Mark Macdonald Photography and clients are not permitted to make further edits or adjustments to the final images in any way.
